Agency Commission: 15% allowed recognized advertising agencies.
Commission not allowed on cost of artwork, conversion charges,
reprints, non-display classified advertising, and any other postage
and mechanical costs.
Bills Rendered: Publication date.
Terms: Net 30 days. If no specific term is indicated, a calendar year
will be utilized. Fiscal terms are permissible if indicated at the
time the contract is received.
Frequency: Rates determined by number of insertions used within a
12-month period. Each unit of a multiple-unit advertisement counts
as an insertion.
Regulations Covering Acceptance of Advertising: As indicated under
"Contract and Copy Regulations" appearing in Standard Rate and Data
Service (SRDS) Business Publication Edition.
Advertising That Simulates Editorial Content: Must carry the word
"Advertisement" in eight-point type on each page.
Liability: Publisher is not liable for delays in delivery and/or
nondelivery in the event of Act of God, action by any governmental
or quasi-governmental entity, fire, flood, insurrection, riot,
explosion, embargo, strikes whether legal or illegal, labor or
material shortage, transportation interruption of any kind, work
slowdown or any condition beyond the control of publisher affecting
production or delivery in any manner.
Short Rate Policy: All rates are based on the number of insertions
contracted for and used with a 12-month period from the date of the
first insertion. Advertisers will be short-rated if, within that
12-month period, they do not use the contracted amount of space upon
which their billings have been based. The short rate will then be
based on the earned frequency of the current published rate card.
Positioning Policy: IndustryWeek will honor as many positioning
requests as possible. All positioning packages provided in a
proposal require a written confirmation within 21 days; otherwise
the specified positions may no longer be available. Additionally,
insertion orders must be received by the posted close date to honor
all position requests. Positions offered will also be considered to
be based on the contracted frequency. Failure to run the specified
number of ads will likely result in the renegotiation of the
positioning package.
Advertiser and agency agree to indemnify, defend and save harmless the
publisher from any and all liability for content of advertisements
printed (including text, illustrations, representations, sketches,
maps, trademarks, labels or other copyrighted matter), or the
unauthorized use of any person's name or photograph, arising from
the publisher's reproduction and publication of such advertisements
pursuant to the advertiser's or agency's order. Publisher reserves
the right to reject, discontinue or omit any advertising or any part
thereof. This right shall not be deemed to have been waived by
acceptance or actual use of any advertising matter.
Publisher reserves the right to hold advertisers and/or their
advertising agencies jointly and severally liable for money due and
payable to the publisher.
